Terms and Conditions of the Use License for Dinkytown.net Financial Calculators
KJE Computer Solutions, Inc. hereby grants to the customer (“Customer”) of the Financial Calculators at Dinkytown.net a non-transferable and non-exclusive license to use the Software (“Software”) under the following terms and conditions.
Ownership
The software, as well as the related copyrights and intellectual property rights, are the exclusive property of KJE Computer Solutions, Inc. and/or its suppliers. The Customer acquires no title, right or interest in the Software other than the license rights granted herein.
The Customer shall not remove from the Software any trademark, tradename, copyright notice or other notice, and shall be responsible for their conservation on the copies received hereunder and for their reproduction on any backup copy of the Software or any portion merged into other programs.
Any source code included with the software is copyrighted by KJE Computer Solutions, Inc. and should not be considered public domain.
License
Under the license granted hereunder, the Customer has the right to use the software only as a 30 day trial on a single internet domain or local computer. The Customer shall not make any other use of the Software without the prior written permission of KJE Computer Solutions, Inc.
The Customer may copy the Software in machine readable form only when necessary for back-up and recovery in case of breakdown, provided such copies are used solely on said single internet domain.
The Customer shall not further duplicate or distribute the Software in any form without the prior written permission of KJE Computer Solutions, Inc. The Customer shall not sell, loan, transfer or license the Software or otherwise assign any rights under this Agreement to any third party without prior written permission.
Limitation of Liability
IN NO EVENT WILL KJE COMPUTER SOLUTIONS, INC. OR ITS SUPPLIERS BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES EVEN IF KJE COMPUTER SOLUTIONS, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM LIABILITY OF KJE COMPUTER SOLUTIONS, INC. SHALL BE LIMITED TO A REFUND OF THE PRICE PAID BY THE CUSTOMER FOR THE SOFTWARE.
Limited Warranty
This Software is provided “as is”, without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the Software is with the Customer.
Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Any portion of this agreement that may be void in no way voids or negates any other portion of this agreement.
KJE Computer Solutions, Inc. does not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be uninterrupted or error free.
Transfer of the License
The Software and/or any license granted hereunder may not be assigned, sublicensed or otherwise transferred by the Customer to any third party without the prior written consent of KJE Computer Solutions, Inc.
Termination of the License
The license granted hereunder may be revoked and terminated by KJE Computer Solutions, Inc. written notice to the Customer if any of the following events occur: breach by the Customer of any provisions hereof, or non-payment by the Customer of any sum due from the Customer in consideration of delivery and license of the Software. Upon termination, KJE Computer Solutions, Inc. reserves the right to take any legal action necessary to recover damages incurred.
Upon termination of the license the Customer shall refrain from any further use of the Software, and KJE Computer Solutions, Inc. may require either the destruction of any copy of the Software in the possession of the Customer or the return of the same to KJE Computer Solutions, Inc.
